Can you take over inactive towns or do they have to be active,if so how do you do it?

Not necessarily in the following order.

1) Make sure you have enough population to qualify for your next town.
2) Find a town that has score >3.
3) Get your barracks up to lvl 20
4) Research all the siege related skills
5) Build some siege engines and other military units.
6) Setup a siege camp outside the town. 
7) Pound it until the population is 25% of the starting value.
8) Storm and capture.

A proposal that was discussed before full siege was released carried this figure, but the final version used 25%.

Can you take over a player's final and only settlement?

If you can what happens to the player? Are they wiped out or rimmed or what?

Examples from other games:

Kings Age: Rimmed, they get to start again on the rim
Konoro Kingdoms: you can't unless in active for 7 weeks

Yes you can. They are restarted elsewhere on the map as a new city, although they do get to keep all of the research that they had at the time of losing their city.

The only thing I didn't know about was #2.  How do you tell what the town's score is?

Look at the player's profile - it lists all cities and the population of each.

Actually wrt to #2 I saw something recently from SC where he said you can siege a zero pop city and as soon as the 12 hour timer is up and the first siege attack happens you get the option to storm and capture/raze.  I presume for pop 3,2 & 1 you have to reduce it to zero.
